Can you get a DUI on a bicycle?

Forgoing the car and cruising downtown on a bicycle is one of the many joys of summertime.

Most cyclists are aware that not wearing a helmet is a ticketable offense and not obeying the rules of the road is a dangerous practice.

However, there seems to be confusion among cyclists over whether riding home after a few patio pints is an acceptable practice.

Are cyclists at risk of being breathalyzed?

The short answer is no.

According to BC RCMP, there are no provisions within the Criminal Code or the BC Motor Vehicle Act which stipulate that a person can't ride a bicycle under the influence.

It should be noted that, depending on the totality of the circumstances an intoxicated person may be arrested and/or face charges or fines for public intoxication or causing a disturbance.
